Scope and customers

For orders placed by customers via our online store www.badaandbou.com, these General Terms and Conditions (GTC) apply exclusively.
The offer in the www.badaandbou.com store is aimed exclusively at consumers (any natural person who concludes the contract for a purpose that can be attributed neither to their commercial nor their independent professional activity, § 13 BGB).

Offer, order process and conclusion of contract

  • The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding online catalog.

  • By clicking the button "Add to cart" you can put desired goods into the shopping cart without obligation. You can view the shopping cart at any time by clicking on the "Cart" link and also remove the items placed there.

  • If you wish to purchase the items contained in the cart, click on the "Cart" link and then enter the required data. Registration is not mandatory.

  • After entering your data and selecting the payment method, the "confirm" button will take you to a confirmation window in which the details of your order will be displayed again. There you can finally check your entries and correct them again if necessary.

  • By clicking the button "Place your Order and Pay" in the final step of the ordering process, you place a binding order for the selected goods.

  • Immediately after submitting your order, you will receive an email confirming receipt of your order (order confirmation). However, this does not constitute an acceptance of your order offer, but merely serves to inform you that we have received your order.

  • The purchase contract is only concluded when we confirm the order with another email (order confirmation) or when the goods are delivered and we thus accept your order offer.

Payment methods

Payment in advance

You can pay in advance. To do this, you transfer the invoice amount specified in the ordering process to the specified account. If you choose payment in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment.

Payment via PayPal

PayPal is an online payment method that works by linking to your bank account or credit card. To pay with PayPal, you must have a PayPal customer account. If you do not yet have a PayPal customer account, you can open one if desired during the ordering process. You can find more information about PayPal at www.paypal.de.


Payment by credit card (MasterCard, Visa)

If you would like to pay with one of the above credit cards, please select the appropriate card in the ordering process and enter the required data in the fields provided. Your credit card account will be charged immediately after we have confirmed the order.

Retention of ownership

The goods remain our property until full payment.

Shipping

Versand & Retoure

The delivery of the goods is made by DHL (www.dhl.de).
The period relevant for the determination of the delivery date begins in the case of payment in advance on the day of receipt of the full purchase price (including VAT and shipping costs), in the case of payment by PayPal as soon as payment is received by PayPal, in the case of payment by credit card upon receipt of the order confirmation.

Shipping costs

The shipping costs are calculated automatically when you place your order.  The costs of the individual shipping zones including the countries are divided as follows:

 

Domestic deliveries (Germany): free of charge

 

Deliveries within the EU:

Shipping zone 1:
Belgium, Denmark, France, Luxembourg, Netherlands, Austria, Poland and Czech Republic,
= 16.85 EUR

 

Shipping zone 2:
Italy, Iceland, Bulgaria, Finland, Greece, Ireland, Croatia, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, Hungary, Estonia, Latvia, Lithuania, Malta, Cyprus.
= 18.95 EUR

Switzerland

Delivery times

As far as in the respective offer no other period is indicated, the supply of the commodity takes place in the inland (Germany) within 3-5 working-days, with foreign supplies within 7-10 working-days after conclusion of a contract (with agreed upon pre-payment after the time of your payment instruction).

 

Please note that there is no delivery on Sundays and public holidays.

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the goods.

by means of a clear statement (eg e-mail) about your decision to revoke this contract. You can use the attached sample revocation form for this purpose, which is, however, not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the revocation

 


If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.

We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.



You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You shall bear the direct costs of returning the goods.

You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

Warranty

In case of defects of the delivered goods, the legal rights exist.
